Wyatt G. Woody1,2,3,4

  • Note*: Some legends concerning the Wyatt & Mary Robertson Woody family include a Wyatt, Jr (1800-1873), married Sally M. ?, and a Samuel (1800- Mar 16, 1873), as sons. While it makes sense that Wyatt had a son Wyatt Jr., I have never found a trace of him anywhere nor have I found a Samuel in the Yancey Co., NC area. However, the 1848 will of Wyatt Woody, "Senior" implys that that a "Jr." may have existed; however, there were at least two other Wyatt Woodys (the grandsons of Wyatt Sr.) living in the area at the time, but they probably would have been too young to warrent the "Senior" for legal purposes. Also,the 1820 Buncombe Co., VA census lists six younger males in the home of Wiatt Woody. This would add weight to the idea of two additional sons. I can find no other source material to help me. If these two people existed, they have left very little evidence.
    The dates attributed to Wyatt Jr. and Samuel come from contributions to Heritage of the Toe River Valley by Lloyd Bailey and to the World Family Tree Vol. 2, #0258. The 1850 Yancey Co., NC census lists George (age 2) & Hosea (age 5) Woody in the home of Wyatt. These boys could have been the sons of Wyatt's daughter Marinda, who was also in the household or they could have been the son's of a desceased son of Wyatt. I have never seen any evidence to identify their parents. Based on the 1850 & 1860 census data, I have assumed that these males were the sons of Marinda and I have no evidence to contridict this assumption. The 1840 Yancey Co., NC census for the Wyatt Woody household lists a male, age 20/30. This male could have been Wyatt Jr. or Sam. The known children of Wyatt seem to be accounted for.
    I lean toward the assumption of at least one more son. This would be Wyatt Jr. I doubt very much that Wyatt Jr. lived to see the 1850 census, if he existed at all.

Since the rest of Wyatt's known sons are accouted for, I posit that this was Wyatt Jr. This is also inferred by the will of the older Wyatt who was termed Wyatt Woody Sr. The Sr. (Senior) would strongly imply that a Wyatt Jr. was alive when the will was signed 3 Feb 1848.)16

Thomas B. Boswell1

  • Event-Misc*: Authors of online genealogies of this line state unequivocally that Mary Gilmer was the wife of Thomas Bozzel (Boswell, Bozwell), son of William M. & Mary Jane Mason Bozwell. It seems that all of these genealogies were derived & copied from a theory put forth by Frank D. Myers based entirely on the fact that his gggf, eldest son of Mary & Thomas, was named Peachy Gilmer Boswell. In many cases, this naming pattern would be a clue pointing to the heritage of the individuals; however, to my knowledge, neither he or any other researcher has found even a smidgen of corroborating evidence to back the theory. The bonds for early Franklin Co., VA marriages have survived and are published. No bond/marriage record has been found for Thomas & Mary Gilmer, even though a bond/marriage record exists for the six other children generally attributed to William and Jane Boswell.

    On the other hand, there is substantial evidence for the marriage of Mary Woody to Thomas Bozzel:

    1. The Dec 10, 1803 Stokes Co., NC marriage bond of Mary Woodey & Thomas Bozzel. Stokes is on the NC/VA border near Franklin/Henry Counties, VA. There are no Woodys or Bozzels (or variations) in the 1800 Stokes Co., NC census.

    2. The Nov 11, 1807 will of Henry Woody of Franklin Co., VA notes his daughter Polly Bozzel. Henry died Dec 7, 1807 and his estate was inventoried Dec 28 , 1807.

    3. The 1810 Franklin Co., VA census for the Thomas Bozzel family: 2-0-1-0-0 & 2-1-0-1-0-0. Six years of marriage and five children. About par for the times.

    4. The 1800 Franklin Co. VA Tax List shows Henry, David, John, Martin, Randolph & Weyott Woody. Also, William Bozwell is listed with six children. William is the assumed father of Thomas and his siblings.

    5. The early marriage bonds of Franklin Co., VA are well documented. The marriage bonds of the other Henry & Susannah Woody children married in Franklin are recorded. The marriage bonds of all the other six William & Mary Bozzel children are recorded.

    6. The first child of Thomas and Mary Bozell was named Susan, bc 1805. Mary Woody's mother was Susannah.

    Summation: In 1803 Thomas Bozzel made a marriage bond with Mary Woodey. At the end of December, 1807, Henry Woody had a married daughter named Polly Bozzel. The December 1807 Thomas Bozzel family most likely consisted of three children, one of which was Peachy G. (born circa 1807 based on later census data)

    Conclusion: Peachy G. was the son of Thomas & Mary Woody Bozzel and so were Peachy's siblings. Mary Gilmer was never married to Thomas Bozzel. Since the vast majority of data point to this conclusion, I will let other "researchers" try to prove a different conclusion based on the facts.

    Two interesting questions remain unanswered at this point:
    1. Why did Thomas and Mary name their child Peachy Gilmer? I doubt that we will ever know for sure, but many children have been named for people that their parents admired or were "indebted" to for some reason.

    2. Why did Mary & Thomas go to NC to get married. I don't know, but I have been informed by resident researchers of the border area that it is/was not an unusual occurrence.

    At any rate, there is more than adequate evidence to support this Woody/Bozzel marriage. In fact, many early marriage assumptions are based on far fewer facts.

    It is possible that Mary Woody Bozzel died and that Thomas then married Mary Gilmer, but the Peachy Gilmer name is the only evidence of this possibility and based on census data, it is almost certain that Peachy was born at the time that when Mary Woody Bozzel was living.

    I have been contacted by Frank Myers, who originated the Gilmer theory. According to Frank, he intended the theory to be a speculative base for further research. Another person published a Boswell pedigree based on this theory without any supporting facts or explanation. Of course, this Gedcom was copied by many others and the supposed Gilmer connection was embellished and extended back several generations. All of these speculations are based on an unsubstantiated guess.

    I would be very pleased to hear from anyone that has any other facts that might bear on the marriage of the subject Thomas Bozzel.

  • Event-Misc*: I have looked far & wide for Philmer/Philemon & Rebecca. Most genealogies assume that Philemon was the son of Thomas of Franklin Co. VA. If so, he does not seem to have accompanied his brothers to Breckinridge Co., KY. Indeed, the ONLY Philemon (or any similar name) I can find is in 1816 in Montgomery Co., TN where he was an overseer of road work. He is also in the 1820 Montgomery Co. census and apparently in the 1830 Rutherford Co., TN census. The last link I can find is in a 1841 Montgomery Voters list.

    A Whitworth family essay found in the Montgomery Co. Genweb archives claims that Fendal Whitworth came to the Montgomery/Cheatham Co., TN before 1800 from Lincoln Co., NC. One of his sons was Philmon. By 1840 this source states that most of this clan had dispersed to Shelby Co., TN, Mississippi, Missouri & Texas. I can find no trace of Philomen in any other census.

    There were a lot of Whitworths, including a Thomas, in Rockingham Co., NC from 1790 to 1810, but no males in 1820. Rockingham is on the NC/VA border near Franklin/Henry Co. VA. Fendal was in Lincoln Co., NC in 1790 census. This Thomas could have been the same one that was in Franklin Co. Also, it is possible that Philomen was not the son of Thomas, but instead Fendal, who could have been one of Thomas' brothers.

    This couple seems to have left Franklin Co. before 1810. They do not seem to be in the 1810 or 1820 VA census. Nor are they in the NC or KY census for the same period. The supposed father of Philemon was Thomas Whitworth found in 1800 Franklin Co. Tax List. Based on online genealogies, most of the family seems to have moved to Breckinridge & Green Counties KY very early; however I have seen material that disputes this. At any rate, Philomen is not found in KY.

    However, a Philemon is found in 1816 Montgomery Co., TN as an overseer of road construction. He is also in 1820 Montgomery Co. census and in 1830 Rutherford Co. census. The last listing I can find is in 1841 Montgomery Co. Voter list.

    The "Whitworth Family", found on Montgomery Co. GenWeb site states that Fendal Whitworth settled in Montgomery/Cheatham Co., TN before 1800 with two sons, Philmon & John. They were supposedly from Lincoln Co., NC. By 1840 the family had dispersed to Shelby Co., TN, Mississippi, Missouri & Texas.

    Also, there were a lot of Whitworths in Rockingham Co., NC about 1800. By 1820, all the males were gone. Rockingham is on the NC/VA border across from Henry/Franklin Co., VA

    I suspect that the TN Philomen is our lad. He may not have been the son of Thomas at all, but the son of a relative in Rockingham or Lincoln counties. I would work court & land records in Montgomery Co., TN. To continue, I suggest That the search be onsite in Montomery Co., TN. Land transactions & court proceedings.
