In this suit, the names of James & Elizabeth Woody Brown's six children are named. None of these children lived in Bedford Co., VA at the time of the suit. The marriage record of Fleming Woody & Martha Gibson names B. & Patsy Woody as Fleming's parents. The marriage record of Sally (Sarah) Woody & John Ward names her as the "daughter of Benjamin Woody".   The death record of John Woody names Benjamin & Martha as his parents. Fleming provided security for John's marriage bond. Martha (Patsy) Woody, age 90, was living in Austin/Augustine's home in the 1850 census. Martha was the widow of Benjamin. Circumstantial association: Samuel was on 1830 Albemarle census with Austin, John & Hawkins. Samuel went to Kanawha Co. with Hawkins & Fleming. Benjamin Woody Jr. married Susannah Hughes, daughter of Robert Hughes. Robert Hughes was also the Father of Jane L. Hughes, the wife of Hawkins Woody. The 1810 Albemarle census for Benjamin Woody Sr. enumerates a male in the 0/5 range. This was most likely Ben Jr,, who was enumerated as 16/18 in the 1830 Albemarle census.

• Note*: I cannot find Austin in the 1850 census. An Austin Woody married Mary Graley/Gentry in 1849 Albemarle, but they are not in the 1850 census. An Austin, James John and Cary are in the 1860 census with no younger individuals listed. An Austin is in the 1870 census with the widow Polixana Bryant and two younger Woody children. A descendant of one of these children, Joel, has been yDNA tested and the result is a good match for the Henry Woody line. All of this data leads me to conclude that Austin was a son of John & Mary Woody and grandson of Benjamin & Martha Woody. There is a slight possibility that he is the son of an unknow son of John and Mary that married Cary ?, but the 1840 census shows one young male in the home of Cary Woody and that male has been proven to be John W. Woody. A son of Cary Woody and ? would not have Woody yDNA unless ? was a Woody also.
